Premarital agreements can help couples start a marriage with a shared understanding of their assets and expectations. These agreements are particularly valuable for people entering a second or subsequent marriage, or where there is a significant disparity in assets between partners. Marital agreements provide clarity about rights and responsibilities for spouses who are already married. We draft and review these agreements, and in the event an agreement needs to be applied (such as in a divorce) we represent clients who want to challenge or enforce an existing agreement.
Divorces involving significant or complex assets (such as an interest in a closely-held business, real estate holdings, or investment portfolios) can pose unique challenges. In particular, a high net worth marital estate can complicate equitable distribution of property and spousal support, as complex assets can be difficult to value. It’s best to work with a family lawyer who is experienced with larger marital estates to avoid inequities and needless conflict.
Certain retirement plans, such as 401(k)s and pensions, are governed by federal ERISA law and must be divided in divorce using a Qualified Domestic Relations Order (QDRO). A declaratory judgment is a court order that exists just to settle a legal question, often within a larger legal case. In the family law context, that might be a declaration that a certain asset is or is not marital property subject to division in divorce, or that a provision in a premarital agreement is or is not valid. We routinely represent clients in declaratory judgment proceedings to clarify rights and responsibilities in family law matters.
If someone violates a family law order, such as by withholding parenting time or failing to turn over assets in a divorce, the other party can file a motion asking the court to enforce the order. The non-compliant party may be held in contempt of court and be required to pay fines or the other party’s attorney fees or face other sanctions, including jail time in the most serious cases.
