Colorado Divorce Process

The legal divorce process in Colorado begins with filing a Petition for Dissolution of Marriage in the district court. One person can start the process on their own, or both spouses can sign the Petition to jointly request a divorce. The minimum time in which a divorce can be granted is 91 days after filing, but in practice it often takes several months to resolve a divorce.

During the divorce process, there is an Automatic Temporary Injunction (ATI) in place to prevent either spouse from hiding or transferring property, cancelling insurance, moving the children out of state, or harassing the other spouse.

In Colorado, divorcing spouses must exchange detailed financial disclosures. Courts also usually require divorcing spouses to go through mediation to resolve disputed issues in their divorce and try to reach settlement. Most divorcing couples do reach a settlement in their divorce, either on their own, through mediation, or by negotiating with the help of their divorce lawyers. Those who do not must go to trial.
